A sexual misconduct and theft incident in one of our residence halls over the weekend is under investigation by the Tompkins County Sheriff"s Department.

Here is what is alleged to have occurred: Very early Sunday morning, two male students were in an apartment shared by four female students. One of the students lives in a residence hall, the other was a visitor. It"s unclear how the male students got into the apartment, but the female students say they didn"t know the males. After sexually propositioning one of the females, one of the males (the visitor) is accused of exposing himself to the females. At that point, one of the females left the apartment, leaving the males in the apartment. When the female student returned, she told the males to leave and they did. After sleeping, the female discovered missing cash, a credit card, and a camera. At this point, she notified residence life staff and then contacted the sheriff"s department.

In addition to the legal investigation by the sheriff"s department, the incident is also being investigated by the College. While the internal investigation is continuing, preliminary actions have been taken against the two accused males. The visitor has been banned from the residence life halls and area. He will be charged with trespassing if he is found at housing again. The status of the male student who lives in the residence halls is being reviewed. He has been ordered to stay away from the female students involved and the apartment where the incident occurred.

As reminder to all of our residents, it is very important to keep your doors locked at all times. Don"t allow people you don"t know into your apartment. Please contact the residence life staff immediately with any problems.

Follow Up

Date: December 7, 2007

This is a follow up to the incident that occurred at our residence halls early Friday, November 30.

The state police initially made two arrests related to the incident. The two males, who were residential students, were charged with second degree robbery, a felony. Additionally, the two faced disciplinary action from TC3.

After our own investigation, one of the two students, Colby Rodriguez, has withdrawn from school and consequentially placed on suspension for two years. If he applies for readmission to the College after those two years, his application would be placed under special review. The second student, Kevin Singh, has been suspended for one year and ordered to complete several educational modules before being readmitted to the College. In both cases, the suspensions include a complete ban from any TC3 property. The students have moved out of the residence halls, and the professors of these students are being notified.

Three other students were charged with playing a less significant role in this incident. The investigation determined one of the students was not involved, and charges against him were dropped. The other two have been charged with criminal possession of stolen property and are going through the campus conduct process.

The victim, who is not a TC3 student, was not seriously injured in this incident.

It is important to note that alcohol played a significant role in this incident. Please urge all of our students to be safe and make smart decisions.

Under advice from the Cortland City Police Department, we are urging all TC3 students to avoid any gatherings at 81 Maple Ave. and 90 Groton Ave. in Cortland. These two addresses are related to recent arrests, with charges including weapon possession and underage drinking.

As a general reminder, it is always important to be cautious when attending large gatherings off-campus. A large party can quickly become a dangerous place, especially if the party involves alcoholic beverages. Please be safe and make smart decisions.
